Terms of Service

These Terms of Service ("Terms") govern your use of the ReadyKin mobile application ("App") provided by Shady Ghalab ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ReadyKin, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

ReadyKin is a reminder and productivity application that helps users remember items and tasks when leaving various locations. The App provides features including:

• Location-based reminders
• Weather-aware suggestions
• Group sharing functionality
• Apple Watch companion app
• Home screen widgets
• Gamification features (achievements, streaks, virtual pets/plants)
• Accessibility modes (Kid Mode, Elderly Mode)

3. User Accounts and Registration

Some features of ReadyKin, such as group sharing, may require account creation or sign-in. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. User Content

Your Content

You retain ownership of all content you create within the App, including reminders, items, notes, photos, and voice recordings ("User Content"). By using the App, you grant us a limited license to store and process your User Content solely to provide the App's functionality.

Content Guidelines

When using group features, you agree not to share content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights
• Contains malware or harmful code
• Violates any applicable laws or regulations

5. Acceptable Use

You agree to use ReadyKin only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit spam or malicious content
• Impersonate any person or entity

6. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by Shady Ghalab and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App or its content without our express written permission.

7. Third-Party Services

The App may integrate with or contain links to third-party services, including:

• Firebase (analytics, cloud services)
• Google AdMob (advertising)
• Weather APIs

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

8. In-App Purchases and Subscriptions

ReadyKin may offer in-app purchases or subscription options for premium features. All purchases are:

• Processed through Apple's App Store
• Subject to Apple's terms and refund policies
• Non-transferable between accounts

Subscription renewals are automatic unless cancelled at least 24 hours before the end of the current period. Manage subscriptions in your App Store account settings.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT

We do not warrant that the App will be uninterrupted, secure, or error-free. Reminder notifications are provided as a convenience and should not be relied upon for critical safety matters.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or system failure
• Missed reminders or notifications
• Any damages arising from your use of the App

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Shady Ghalab from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App ceases immediately
• We may delete your User Content
• Provisions that should survive termination will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through:

• In-app notifications
• Updates to the "Last Updated" date

Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If resolution cannot be reached, disputes may be submitted to binding arbitration in accordance with applicable laws.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of ReadyKin and supersede any prior agreements.

19. Apple-Specific Terms

If you are using ReadyKin on an Apple device, you also agree to the following:

• These Terms are between you and Shady Ghalab, not Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties
• Apple is not responsible for any claims related to the App
• Apple is a third-party beneficiary of these Terms
